Debbie Holliman began practicing law in 1986 in Smith County, Tennessee, with her original office on the corner of West Third Avenue in Carthage. She began her practice doing real estate closings and transactions, Social Security disability representation, criminal law, and domestic relations litigation. She continued to expand her areas of practice and began representing local people who had been injured in motor vehicle accidents or work related injuries. In June of 1990, Mrs. Holliman moved her practice to 324 North Main Street in the old Glenn Sanderson building which had originally housed a dry goods company. The building was totally remodeled and restored. She opened to the public on June 29, 1990. Mrs. Holliman continues her practice in this location.

Guy Holliman's principal office is located in Lafayette, Macon County, Tennessee, where he practices with Frank D. Farrar and Joseph "Joey" Butler. Mr. Holliman also has an office of practice in McMinnville, Warren County, Tennessee. He is of counsel in the Carthage office of his wife, Debbie, and they regularly work on cases together.

The Hollimans are the parents of two boys, Dalis Davis Holliman, age 21, and Hayden Campbell Holliman, age 17. When not practicing law for a living, Debbie and Guy work on the 300 acre family farm, which includes beef cattle, meat goats, several horses, burros, dogs, cats and chickens.

Debbie and Guy have extensive trial experience in the Middle Tennessee area specializing in representing hard working class people and others against large insurance companies, national manufacturers, and other business conglomerates. They have argued numerous cases in the Tennessee Supreme Court and Tennessee Court of Appeals and have experience in Sixth Circuit Federal Court of Appeals and Federal District Court Sixth Circuit.

Debbie Holliman

Some of the more important recent Supreme Court cases that have been won by Debbie and Guy Holliman are as follows:

David E. Clark v. Lowe's Home Centers and State of Tennessee, Second Injury Fund, 201 S.W.3d 647. Mr. Clark had a prior workers' compensation claim. He was discharged by Lowe's because they no longer had work for him within his restrictions. Mr. Clark filed suit to have his prior claim reconsidered and to enlarge his award since he had been discharged. The Hon. James O. Bond, Judge, ruled the previous award could be enlarged and awarded Mr. Clark an additional 214 weeks of benefits. Judge Bond apportioned the award between the employer and the Second Injury Fund. The Second Injury Fund appealed because it interpreted the laws to be that because Mr. Clark had suffered a subsequent work related injury for which he sought compensation, he could not obtain reconsideration of his prior award. The Supreme Court ruled that reconsideration of a prior award under the Tennessee worker's compensation laws is not prohibited by a subsequent work-related injury for which the employee seeks compensation. They agreed with Judge Bond's ruling and awarded benefits to Mr. Clark.

Billy Overstreet v. TRW Commercial Steering Division, et al., 256 S.W.3d 626. Mr. Overstreet suffered a work related injury (hearing loss). The employer filed a motion for permission to question Mr. Overstreet's treating physician outside of the presence of Mr. Overstreet and his attorneys. Chancellor C.K. Smith denied the request. The employer appealed the Chancellor's ruling. The Supreme Court agreed with Chancellor Smith's ruling and stated that an employee seeking benefits under the Workers' Compensation Act retains the privilege against the non-disclosure of personal health information except to the extent that this privilege has been altered by federal or state law. Neither state nor federal law requires or permits employers or their agents to have discussions with their employee's treating physicians without the employee present or an agreement. Therefore, a physician's fiduciary duty to refrain from disclosing a patient's confidential health information prevents that physician from engaging in discussions, unless the patient expressly or impliedly consents or unless the law requires or permits disclosure.
